1. Introduction

This website is operated by DefendAPack, LLC. DefendAPack is a Registered Trademark with the USPTO, with rights included therein. Any use or reuse of the word or logo in any form, without the written permission of the owners is strictly prohibited.

The terms “we”, “us”, and “our” refer to DefendAPack, LLC. The use of our website is subject to the following terms and conditions of use, as amended from time to time (the “Terms”). The Terms are to be read together by you with any terms, conditions or disclaimers provided in the pages of our website. Please review the Terms carefully. The Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and our Privacy Policy. If you do not agree to the Terms or our Privacy Policy, you are not authorized to access our website, use any of our website’s services or place an order on our website.

DefendAPack products are designed to enhance the safety in schools, and college classroom safety as well as to provide individual child and children’s safety, teacher safety,  staff safety, as well as workplace safety and other public places.

Always follow safety and security policies procedures and use good personal safety tactics when wearing or using any DefendAPack product.

It is important to know that No body armor or ballistic resistant material or product has been created that is 100% bullet proof.

The terms Bullet proof, Bulletproof Backpack, Bulletproof Backpacks, Bullet proof Backpack, Backpack plate, Bullet proof backpacks and bulletproof vest, bullet proof vest and vests, bullet proof clothes and bulletproof clothing are generally accepted popular descriptive terms applied to DefendAPack products in order to explain ballistic resistant material classification.

Ballistic Protection may also save lives in a bomb blast with fragmentation shrapnel and explosive incidents.

There are thousands of cases of shrapnel being stopped by body armor.

However, shrapnel and fragments can take so many shapes and forms that it is very difficult to “rate” the levels of protection. Ammunition based rating systems, like the NIJ Threat Level system, seem to be the best way to measure the strength of a material in a projectile impact blast protection test.

Threat Level IIIA is the HIGHEST level of protection available in soft body armor (vests). Level III is a higher level of protection in the form of “hard” armoring: Ceramic, Composite or Metal Plates in pockets that protect the most vital, center of mass, organs, other than the head.

2. Use of our Website

You agree to use our website for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By agreeing to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract.

You agree to not use our website to conduct any activity that would constitute a civil or criminal offence or violate any law. You agree not to attempt to interfere with our website’s network or security features or to gain unauthorized access to our systems.

You agree to provide us with accurate personal information, such as your email address, mailing address and other contact details in order to complete your order or contact you as needed. You agree to promptly update your account and information. You authorize us to collect and use this information to contact you in accordance with our Privacy Policy.

3. General Conditions

We reserve the right to refuse service and sales to anyone, at any time, for any reason. We reserve the right to make any modifications to the website, including terminating, changing, suspending or discontinuing any aspect of the website at any time, without notice. We may impose additional rules or limits on the use of our website. You agree to review the Terms regularly and your continued access or use of our website will mean that you agree to any changes.

You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of our website or for any service, content, feature or product offered through our website.

4. Products or Services

All purchases through our website are subject to product availability. We may, in our sole discretion, limit or cancel the quantities offered on our website or limit the sales of our products or services to any person, household, geographic region or jurisdiction.

Prices for our products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in Canadian dollars.

We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or re-sellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.

We do not guarantee the accuracy of the color or design of the products on our website. We have made efforts to ensure the color and design of our products are displayed as accurately as possible on our website.

We have a 30-day Limited Warranty on the workmanship of the DefendAPack Vest ONLY.

5. Body Armor Purchasing Laws and Regulations

In order to purchase any of our products, you must not have a criminal record, be on probation, or be under a criminal investigation of any kind.

By federal law, you must also be purchasing the product for yourself, or your child. You will not be permitted to buy any of our products for any one else with a criminal record, on probation, or anyone under criminal investigation.

Body armor is legal in all 50 states for law-abiding citizens.

As a US citizen or resident of the US you have the right to protect yourself. You have the right to own a bulletproof vest. However, that right to own a bulletproof vest is automatically taken away if you commit a violent crime. The James Guelff and Chris McCurley Body Armor Act of 2002 stipulates that no person previously convicted of a violent crime may purchase, own or possess body armor. If you have been convicted of a violent felony, you cannot own a bulletproof vest of any kind.

There is no background check, waiting period, or federal registration required to buy body armor. No permits or paperwork required to legally purchase it and/or own as a civilian.
You can order our products and have them delivered to your home or office without asking permission or reporting to anyone. You do not need to register it with authorities.

Body armor is legal in all 50 states with ONLY the following three restrictions:

  1. Body Armor is illegal if you have been convicted of a violent felony.
  2. Body armor may not be shipped to a civilian in Connecticut. Body armor purchases in Connecticut are not allowed by Connecticut state regulations to occur over the internet; they MUST be made only through an in-person store purchase.
  3. Wearing body armor while committing a crime will increase penalties greatly. Body armor was not designed for nor intended for criminals!

You can purchase your products online and take delivery in 49 of the 50 states. The one exception is Connecticut, which requires that you buy a bulletproof vest in person, not online for delivery. You can still own a bulletproof vest if you live in Connecticut, we just cannot ship vests to Connecticut.

6. Links to Third-Party Websites

Links from or to websites outside our website are meant for convenience only. We do not review, endorse, approve or control, and are not responsible for any sites linked from or to our website, the content of those sites, the third parties named therein, or their products and services. Linking to any other site is at your sole risk and we will not be responsible or liable for any damages in connection with linking. Links to downloadable software sites are for convenience only and we are not responsible or liable for any difficulties or consequences associated with downloading the software. Use of any downloaded software is governed by the terms of the license agreement, if any, which accompanies or is provided with the software.

7. Use Comments, Feedback, and Other Submissions

You acknowledge that you are responsible for the information, profiles, opinions, messages, comments and any other content (collectively, the “Content”) that you post, distribute or share on or through our website or services available in connection with our website. You further acknowledge that you have full responsibility for the Content, including but limited to, with respect to its legality, and its trademark, copyright and other intellectual property ownership.

You agree that any Content submitted by you in response to a request by us for a specific submission may be edited, adapted, modified, recreated, published, or distributed by us. You further agree that we are under no obligation to maintain any Content in confidence, to pay compensation for any Content or to respond to any Content.

You agree that you will not post, distribute or share any Content on our website that is protected by copyright, trademark, patent or any other proprietary right without the express consent of the owner of such proprietary right. You further agree that your Content will not be unlawful, abusive or obscene nor will it contain any malware or computer virus that could affect our website’s operations. You will be solely liable for any Content that you make and its accuracy. We have no responsibility and assume no liability for any Content posted by you or any third-party.

We reserve the right to terminate your ability to post on our website and to remove and/or delete any Content that we deem objectionable. You consent to such removal and/or deletion and waive any claim against us for the removal and/or deletion of your Content.

You agree to defend and indemnify us, and hold us and our affiliates harmless, and our and their respective directors, officers, agents, contractors, and employees against any losses, liabilities, claims, expenses (including legal fees) in any way arising from, related to or in connection with your use of our website, or purchase and use of any DefendAPack product. Your violation of the Terms, or the posting or transmission of any materials on or through the website by you, including but not limited to, any third party claim that any information or materials provided by you infringe upon any third party proprietary rights.

12. Entire Agreement

The Terms and any documents expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of the Terms and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing. Both you and we acknowledge that, in entering into these Terms, neither you nor we have relied on any representation, undertaking or promise given by the other or implied from anything said or written between you and us prior to such Terms, except as expressly stated in the Terms.

13. Waiver

Our failure to exercise or enforce any right or provision of the Terms will not constitute a waiver of such right or provision. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us is effective unless it is communicated to you in writing.

15. Severability

If any of the provisions of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law. 

16. Governing Law

Any disputes arising out of or relating to the Terms, the Privacy Policy, use of our website, or our products or services offered on our website will be resolved in accordance with the laws of the State of Florida, County of West Palm Beach, without regard to its conflict of law rules. Any disputes, actions or proceedings relating to the Terms or your access to or use of our website must be brought before the courts of the State of Florida, County of West Palm Beach and you irrevocably consent to the exclusive jurisdiction and venue of such courts.

17. Personal Use Product

Purchasing DefendAPack products for resale purposes is prohibited and is a violation of patent and trademark laws.  DefendAPack products are intended for personal use only.  Violaters will be prosecuted to the full extent of the law.

Body Armor Laws By State

Alabama

Alabama does not have any additional body armor laws. In Alabama, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Alaska

In Alaska, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Arizona

Like many states, Arizona has a law in place that makes it illegal to wear body armor during the commission of a crime. This does not affect body armor retailers.

Arkansas

In Arkansas, it is a Class A Misdemeanor to possess body armor if you have been convicted of murder, manslaughter, aggravated robbery, assault, or battery. This law does not affect body armor retailers.

In Arkansas, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

California

In California, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Colorado

In Colorado, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Connecticut

Of all the states, Connecticut has the toughest law on body armor, prohibiting residents from buying or selling body armor on line. Purchases can only be done through a face-to-face sale.

In Connecticut, it is a class B misdemeanor, punishable by imprisonment for up to six months, a fine of up to $1,000, or both, to sell or deliver body armor unless the transferee meets in person with the transferor to accomplish the sale or delivery. The law exempts sales or deliveries to:

  1. authorized officials or sworn members of local police departments, the State Police, the Division of Criminal Justice, the Department of Correction, or the Board or Pardons or Parole;
  2. authorized municipal or Department of Administrative Services' officials who buy body armor for the above agencies;
  3. authorized Judicial Branch officials who buy body armor for probation officers; and
  4. members of the National Guard or armed forces (CGS § 53-341b).

Delaware

Like many states, Delaware has a law in place that makes it illegal to wear body armor during the commission of a crime. This does not affect body armor retailers.

Florida

Like many states, Florida has a law in place that makes it illegal to wear body armor during the commission of a crime. This does not affect body armor retailers.

In Florida, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Georgia

Like many states, Georgia has a law in place that makes it illegal to wear body armor during the commission of a violent crime, or while trafficking drugs. This does not affect body armor retailers.

In Georgia, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Hawaii

In Hawaii, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Idaho

In Idaho, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Illinois

Illinois does not have any additional body armor laws pertaining to retailers. In Illinois, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

However, it is illegal to for individuals to wear body armor while in possession of a dangerous weapon, other than a firearm, during the commission or attempted commission of any offense. Unlawful use of body armor is a Class A misdemeanor.

Indiana

In Indiana, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

A person who knowingly or intentionally uses body armor while committing a felony commits unlawful use of body armor, a Class D felony (up until July 2014, when a new law takes effect). The new law states that a person who knowingly or intentionally uses body armor while committing a felony commits unlawful use of body armor, a Level 6 felony. Again, this law effects criminals, not retailers.

Iowa

In Iowa, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Kansas

In the city of Topeka, Kansas, it is illegal to possess, carry or wear a bulletproof vest during protests, parades, rallies, assemblies and demonstrations. This statute does not affect retailers.

In Kansas, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Kentucky

In Kentucky, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Louisiana

Like many states, Louisiana has a law in place that makes it illegal to wear body armor during the commission of a crime. Additionally, body armor cannot be worn on school property. This does not affect body armor retailers.

In Louisiana, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Maine

In Maine, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Maryland

Maryland law mandates that all persons with a prior conviction for a crime of violence, or a drug trafficking crime, are prohibited from using, possessing, or purchasing bulletproof body armor without a permit issued by the Secretary of the Maryland State Police.

A person with a prior conviction for a crime of violence or a drug trafficking crime may file, for good cause shown, a petition with the Secretary for a permit to use, possess, and purchase bulletproof body armor.

Massachusetts

Like many states, Massachusetts has a law in place that makes it a felony to wear body armor during the commission of a crime. This does

In Massachusetts, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Michigan

In Michigan, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Michigan Laws Regarding Committing a Crime While Wearing Body Armor:

(1) Except as provided in subsection (2), an individual who commits or attempts to commit a crime that involves a violent act or a threat of a violent act against another person while wearing body armor is guilty of a felony, punishable by imprisonment for not more than 4 years, or a fine of not more than $2,000.00, or both. A term of imprisonment imposed for violating this section may be served consecutively to any term of imprisonment imposed for the crime committed or attempted.

(2) Subsection (1) does not apply to either of the following:

(a) A peace officer of this state or another state, or of a local unit of government of this state or another state, or of the United States, performing his or her duties as a peace officer while on or off a scheduled work shift as a peace officer.

(b) A security officer performing his or her duties as a security officer while on a scheduled work shift as a security officer.

(3) As used in this section:

(a) “Body armor” means clothing or a device designed or intended to protect an individual's body or a portion of an individual's body from injury caused by a firearm.

(b) “Security officer” means an individual lawfully employed to physically protect another individual or to physically protect the property of another person.

Minnesota

In Minnesota, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Mississippi

In Mississippi, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Missouri

In Missouri, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Montana

In Montana, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Nebraska

In Nebraska, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Nevada

In Nevada, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

New Hampshire

New Hampshire has laws in place that make committing a crime while wearing a bulletproof vest a felony, but does not have laws in place that prohibit sales of bulletproof vests by retailers.

650-B:2 Felonious Use of Body Armor. – I. A person is guilty of a class B felony if he commits or attempts to commit any felony while using or wearing body armor.

New Jersey

In New Jersey, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Additionally, in New Jersey, a person can be charged separately for wearing a bullet proof vest while carrying out criminal acts. The practical effect is more jail time and fines. Separate penalties have a wide range depending on the seriousness of the underlying crime.

New Mexico

In New Mexico, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

New York

In New York, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Section 270.20 Unlawful Wearing of a Bullet Proof Vest

A person is guilty of the unlawful wearing of a body vest when acting either alone or with one or more other persons he commits any violent felony offense defined in section 70.02 while possessing a firearm, rifle or shotgun and in the course of and in furtherance of such crime he wears a body vest. The unlawful wearing of a vest is a class E felony.

North Carolina

Like many states, North Carolina has a law in place that makes it illegal to wear body armor during the commission of a crime. This does not affect body armor retailers.

In North Carolina, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

North Dakota

In North Dakota, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Ohio

Ohio does not have any additional body armor laws. In Ohio, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Oklahoma

Like many states, Oklahoma has a law in place that makes it a felony to wear body armor during the commission of a crime. This does not affect body armor retailers.

In Oklahoma, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Oregon

In Oregon, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Pennsylvania

Pennsylvania does not have any additional body armor laws. In Pennsylvania, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Rhode Island

In Rhode Island, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

In 2012, Rhode Island's General Assembly passed a bill that forbids anyone convicted of a felony that is a crime of violence from buying or possessing body armor. This does not affect retailers of bullet proof vests.

South Carolina

Like many states, South Carolina has a law in place that makes it illegal to wear body armor during the commission of a crime. This does not affect body armor retailers.

In South Carolina, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

South Dakota

In South Dakota, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

 Tennessee

Tennessee has a law in place that makes it illegal to wear body armor during the commission of a crime. The unlawful wearing of a vest is a Class E felony. This does not affect body armor retailers.

In Tennessee, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Texas

In Texas, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Utah

In Utah, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Vermont

Vermont does not have any additional body armor laws. In Vermont, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Virginia

Virginia has one additional body armor law, like many states: Any person who, while committing a crime of violence or a felony violation, has in his possession a firearm or knife and is wearing body armor designed to diminish the effect of the impact of a bullet or projectile, shall be guilty of a Class 4 felony. This law does not affect retailers.

In Virginia, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Washington State

West Virginia

In West Virginia, a person who wears or is otherwise equipped with body armor while committing a felony offense, an element of which is force, the threat of force, physical harm to another or the use or presentment of a firearm or other deadly weapon, is guilty of a felony. This does not affect body armor retailers.

In West Virginia, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Wisconsin

In Wisconsin, any adult can purchase and use a bulletproof vest, unless that adult has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

In Wisconsin, donning a bulletproof vest during a felony or attempted felony can lead to an additional felony conviction, or the adding of extra years to the final prison sentence. Again, this law affects certain individuals who might wear bulletproof vests, but does not affect retailers.

Wyoming

In Wyoming, anyone can purchase and use a bulletproof vest, unless he or she has been convicted of a felony. Bulletproof vests and all other body armor can be purchased online or face-to-face.

Where can retailers sell body armor:
1.  You can sell body armor to any person in a face-to-face transaction.  No ID or background check is required and no special record keeping is needed.
2.  You can ship body armor to 49 states.  Sales to customers in Connecticut can only be done via face-to-face transaction.
3.  You can sell body armor via a store, gun show, website, via the phone or catalog.

Where are retailers not allowed to sell body armor:
1.  You cannot sell body armor to Connecticut via the mail.
2.  You cannot ship, take, bring, or send body armor outside the USA without Federal permission.
